ARTICLE 1. OUR COMMERCIAL POLICY

Baby&Oak sells products on its website (hereinafter the “Site”) as part of its e-commerce activity, exclusively for end users, hereinafter referred to as the “Customer.”

By “Customer,” we mean any natural person not acting for professional or commercial purposes. The Site reserves the right to decline any order that does not comply with its commercial policy.

These General Terms of Sale (GTS) exclusively govern all online sales made on the Site. By placing an order, the Customer acknowledges having read and accepted these GTS without reservation.

ARTICLE 2. PURCHASES ON THE BABY&OAK SITE

  • Product descriptions, prices (including VAT), payment methods, and delivery options are specified on the Site.
  • Products available for sale are those displayed on the Site, subject to stock availability.
  • If a product becomes unavailable after ordering, Baby&Oak will inform the Customer and refund the unavailable item.
  • Products are described as accurately as possible. Photos are non-contractual (variations may occur due to screen display settings).

ARTICLE 3. PRICES

All prices shown on the Site are in euros (€), inclusive of VAT but excluding delivery fees. Delivery fees are specified before order confirmation. Baby&Oak reserves the right to change its prices at any time; however, prices charged are those in effect at the time of purchase.

ARTICLE 4. PAYMENT METHODS

  • Credit/debit card (secure payment via Shopify Payment)

  • Digital wallets (Apple Pay, Google Pay)
  • Bancontact, iDeal

Payment is due immediately upon order. All transactions are secured through encryption, and no banking data is stored by Baby&Oak.

ARTICLE 5. DELIVERY

Preparation and delivery times are specified during checkout and detailed in our shipping policy available on the Site. Delivery is only made to valid addresses (excluding P.O. boxes, hotels, temporary or collective residences). A tracking number will be sent by email once your order has shipped.
Delivery zones, times, and applicable fees may vary; they are always indicated before order confirmation.

ARTICLE 6. RIGHT OF WITHDRAWAL – RETURNS – EXCHANGES

No return, exchange, or refund can be accepted for training pants, mattress protectors, swimwear, inserts, detergents, or any hygiene-related product (even if unopened), except in the case of a proven defect.
A size exchange may be considered if the size selected was objectively appropriate (based on our size guide) and the product is clearly unsuitable upon fitting.

For any claim relating to a manufacturing defect, please contact customer service through the form here within 10–14 days after receiving your parcel, including a photo for verification. After validation, an exchange will be arranged free of charge.

If an exchange is not possible, a store credit or partial refund may be offered on a case-by-case basis.
No returns or refunds will be accepted for: change of mind, dissatisfaction with the country of manufacture, or misuse of the product.

The “30-Day Stress-Free Potty Training Guarantee” applies under the conditions specified on the Site (see FAQ). In cases of non-compliance with usage conditions, inappropriate behavior toward our team, or public defamation, the guarantee may be terminated immediately.

ARTICLE 7. LEGAL WARRANTIES

The Customer benefits from the legal guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).

ARTICLE 8. PERSONAL DATA

Personal information collected is necessary for order processing and delivery. This data is strictly confidential and will never be shared with unauthorized third parties. In accordance with the French “Informatique et Libertés” law of January 6, 1978, and the GDPR, the Customer has the right to access, rectify, or delete their data by emailing contact@babyandoak.fr or using the contact form here.

ARTICLE 9. INTELLECTUAL PROPERTY

All elements of the Site — including text, images, logos, and trademarks — are protected by intellectual property laws and remain the exclusive property of Baby&Oak. Any partial or total reproduction without written authorization is strictly prohibited.

ARTICLE 10. GOVERNING LAW

These General Terms of Sale are governed by English law. In the event of a dispute, every effort will be made to reach an amicable resolution. If no agreement can be reached, the competent courts will be those of Baby&Oak’s registered office.
